Energize Denver Small Building Compliance

Buildings under the Energize Denver ordinance 5000- 24,999 sq ft commonly meet their obligation by having 90% of their lighting load be from LED lights, as well as submitting the correct application and supporting documentation. What if I'm already 90% LED?

Most commercial buildings have already taken steps to improve their lighting systems for energy savings, maintenance savings, and improved lighting quality. If your building is already LED, or you meet the 2019 Denver Building and Fire Code, you still need to submit your application and audit on time, and this can be a tedious process that Compliance Expert LLC has experience with. There are other compliance options available if 90% LED lighting is not obtainable.

Renewable Energy Option

If 20% of your power is generated by onsite or offsite renewable sources, you will need to submit the Renewable Energy Compliance Form. Xcel Energy's Renewable Connect program will qualify but often is not available, so plan ahead if this is your planned pathway.

Residential Condo Option

Because it may be challenging to update all residential units in a condo complex this alternative requires you to certify in the common spaces, 100% of the lighting is LED, install occupancy sensors, and 100% of the power is from renewable sources.

15% Energy Reduction Option

If the above options aren't viable, Compliance Expert LLC can help put together a plan for 15% energy reduction including an ASHRAE Level 1 assessment, site energy usage calculation, retrofit plan, and obtaining bids. We are here to help.

Timeline Extension

If circumstances delay meeting the Energize Denver requirements a timeline extension may be applied for. The reasons include planning for a major renovation, financial distress, financial solvency, building ownership change, interruptions to production, change of ownership, vacancy rate, equity priority, and others.

Penalties

The cost of not taking any action is $1.60/sq ft. Partial compliance with LEDs is $1.60/sq ft not in compliance. Penalties for partial renewable energy is $.33/kBtu not achieved. Faliure to correct errors, withholding information, or nondisclosure upon sale is $2000. Failure to pay within 180 days of citation will result in property lien.
